Terms of Service
By using the simlek mobile application (the "App") or the simlek.app website (the "Site") you agree to these Terms of Service (the "Terms"). A separate Privacy Policy and KVKK Notice also apply.
If you do not agree to these Terms, do not use the App.
1. The Service
simlek is a tool that crawls publicly accessible product pages of third-party retailers (Zara, Mango, Bershka, etc.) and sends you a notification when a size you've selected returns to stock. simlek does not sell any product; all purchases happen on the retailer's own website, not through simlek.
2. Age
You must be at least 13 years old to use the App. In Türkiye, users under 18 are advised to obtain parental or guardian consent.
3. Account
- You may use the App anonymously at first.
- Creating watches or receiving notifications requires Sign in with Apple or Sign in with Google.
- You are responsible for the security of your device — anyone with access to it can access your account.
- You can delete your account in-app at any time via Profile → Delete Account. This does NOT cancel an active subscription; subscriptions must be cancelled via Apple/Google.
4. Acceptable Use
You agree not to use the App to:
- Engage in unlawful, fraudulent, or rights-infringing activity.
- Automate, scrape, reverse-engineer, or reproduce the App or our infrastructure.
- Generate request volumes designed to abuse our quotas or the retailers' server resources (e.g. mass accounts, watch automation).
- Resell the service or transfer your subscription rights to third parties.
- Harass or harm other users.
We may suspend or close accounts that violate these rules without prior notice.
5. Relationship with Retailers
simlek is not affiliated with, endorsed by, or officially partnered with any retailer named in the App. Brand names are used solely for identification. Product images, prices, and stock data are pulled automatically from the retailers' own sites and may change.
You acknowledge that changes on the retailers' sites may affect the service, and that we may add, pause, or permanently remove support for any retailer.
6. Subscription and Fees
6.1. Free plan
You can use the App with basic features for free. The number of concurrent watches and other limits are shown in-app and may change over time.
6.2. Premium subscription
- You may purchase a monthly or yearly Premium subscription. Current prices are shown on the Premium screen in-app, in the local currency and taxes as set by Apple App Store and Google Play.
- Subscriptions auto-renew. Unless you cancel at least 24 hours before the end of the current period, Apple/Google will charge your account for the next period.
- Cancellation can only be made through your Apple App Store or Google Play account settings. Deleting the App does not cancel the subscription.
- Refunds are governed by Apple/Google's refund policy. simlek cannot issue refunds directly.
6.3. Referral codes and promotions
- Some referral codes may grant free Premium access for a limited time. Codes are one-time-use and non-transferable.
- Promotional periods do not auto-renew; you must purchase a plan to continue with Premium.
6.4. Price changes
We may change prices from time to time. The price of your current subscription will not change until the next renewal. New prices will be announced in-app or by email at least 30 days before they take effect; if you don't accept the change you may cancel.
7. Intellectual Property
The simlek name, logo, software, design, and content belong to simlek or its licensors. These Terms grant you a personal, non-commercial, non-exclusive, non-transferable right to use the App; all other rights are reserved.
Retailers' brand names, logos, and product images are the property of their respective owners and are displayed for identification under fair-use principles.
8. Disclaimer
simlek strives for accurate and timely stock alerts, but we do not warrant that:
- Notifications will always be delivered on time or without errors.
- A product or size will actually be in stock when notified (retailer pages and real inventory may be out of sync).
- Retailer prices or descriptions will always be current.
- The service will run uninterrupted, error-free, or vulnerability-free.
The App is provided "as is" and "as available". To the maximum extent permitted by law we disclaim all express or implied warranties.
9. Limitation of Liability
To the maximum extent permitted by law, simlek is not liable for lost profits, lost data, missed purchase opportunities, or any indirect, incidental, special, or consequential damages. In any case our total liability is limited to the fees you paid in the 12 months preceding the dispute (zero for free users).
10. Termination
You may terminate these Terms at any time by deleting your account. We may suspend or close your account for violations, abuse, or legal obligations. After closure:
- Active Premium subscriptions remain valid until expiry unless cancelled via Apple/Google.
- Personal data is deleted per the retention windows in the Privacy Policy.
- If your account is closed by us due to our error, the unused portion of any subscription may be refundable; refunds are processed by Apple/Google.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Türkiye. Any dispute arising from or related to these Terms shall be subject to the exclusive jurisdiction of the Istanbul (Çağlayan) Courts and Enforcement Offices. This clause preserves the jurisdictional rights granted to consumers under Turkish Consumer Protection Law.
12. Changes
We may update these Terms from time to time. Material changes will be announced at least 30 days before they take effect, in-app or by email. Continued use of the App after the effective date constitutes acceptance of the updated Terms.
